Defending Your Charges | Protecting Your Driving Privileges
Virginia has some of the toughest drunk driving laws in the country. Interstate 81 is busy with trucking traffic, out-of-state travelers, visitors passing through and local residents. Local law enforcement is out in force and they are well trained in what they need to do to make a DUI charge stick. If you have been arrested and charged with a DUI/DWI, and your Breathalyzer test was .08 blood alcohol concentration (BAC), the court presumes that you are guilty.
It is hard to win a DUI case in Virginia. I have been defending individuals charged with DUI/DWI for more than 30 years. At my law firm, Charles R. Allen, Jr., Attorney at Law, I represent underage drinkers who have been arrested for drunk driving, as well as out-of-state visitors and local residents. I also handle other alcohol violation issues, such as underage drinking and minor in possession (MIP) cases. Virginia is a zero-tolerance state for drivers under the age of 21.
I will be candid in my legal advice to you. Please be aware that Virginia is a tough DUI/DWI state, and most cases plead to a resolution rather than go to trial.
Building Your DUI/DWI Defense
Your case, like many others, will depend upon a variety of factors. As your Roanoke and Salem DUI attorney, I will look at the following issues to build your defense.
- Was the traffic stop legal and did the arresting officer have probable cause?
- Did your traffic stop involve a breath test refusal? If you took the Breathalyzer test, what was the reading?
- Do you have a past record of DUI/DWI charges or convictions?
- Were all procedures followed properly during the traffic stop, like field sobriety test, blood alcohol test, informing of your rights before making a statement and other arrest procedures?
As your lawyer, I will examine all the reports and evidence, including any eye witnesses. If there are irregularities, I will seek the exclusion of evidence and the dismissal of charges, as appropriate.
